Our Services are very diverse, so sometimes additional terms or product requirements (including age requirements) may apply. Additional terms will be available with the relevant Services and those additional terms become part of your agreement with us if you use those Services.

a) Eylorin Products, Services & Solutions

As used in these Terms, the term “Eylorin Products, Services & Solutions” shall mean all of the following: all Eylorin Products, Services & Solutions, functionality and services, now available or added in the future, whether branded Eylorin or a different name, and whether available through the Eylorin Products, Services & Solutions website or mobile site as operated as a domain or subdomain (“Website”) or through an application or functionality offered by another third party the logos, designs, text, images, videos, graphics, software and other content and materials of Eylorin or its licensors available through the Eylorin Products, Services & Solutions and the selection and arrangement thereof and Eylorin’s hardware, software and networks associated with making Eylorin Products, Services & Solutions available to you.

Eylorin Products, Services & Solutions offers you the ability to store account information, transactional information and other related information such as addresses, payment methods or other data that Eylorin has decided are eligible to be used with the Eylorin Products, Services & Solutions and the ability to use the Eylorin Products, Services & Solutions as a solution to carry out or perform as prescribed for the functionalities and intended use, or with other third parties.

While using the Eylorin Products, Services & Solutions you will be promoted to transact or carry out payments using different payment methods, we will transmit your payment and related information to the merchant, or other applicable third party, in order to allow them to process the transaction.

You agree that the merchant or other applicable third party can transmit information about the transaction to the applicable network for your eligible transaction to be performed as per selected transaction instruction(s), while the Eylorin Products, Services & Solutions helps facilitate the transaction, Eylorin Products, Services & Solutions is not a party to the transaction or performance of actions relating third party where Eylorin is not explicitly stated while or in use of Eylorin Products, Services & Solutions. This is solely between you and the third party.

Where reserval of such actions or transactions completed is required, you must contact the applicable third party, merchant and/or the financial institution or other entity which facilitated, initiated the transaction. Please remember that Eylorin is not a party to the transaction, and thus Eylorin is not able to resolve any such issues that you may have with the transaction.

You acknowledge that the account information and other related information or data stored or provided through use of the Eylorin Products, Services & Solutions are provided by you or, in certain jurisdictions, on your behalf by your representative or third party, and contain personal financial information. You acknowledge and agree that you are solely responsible for the completeness and accuracy of such data or information you store with the Eylorin Products, Services & Solutions or provide through use of the Eylorin Products, Services & Solutions. Although Eylorin may perform certain validation checks for such information and data, Eylorin is not responsible for the accuracy such data or information collected or provided by you or your representative or third. However, you understand that you, your representative or third party are obliged to provide updated and true information as requested for when using Eylorin Products, Services & Solutions.

b) Service Terms

Eylorin Products, Services & Solutions are available to all individuals, entities and organizations, – the legal age of majority in their jurisdiction, province or territory of residence, able to Access the Internet on a computer or other device; and authorized users or representative of one or more accounts or access in relations to their Accounts or Access. Access to the Eylorin Products, Services

• Solutions from any location where it is illegal or otherwise restricted is prohibited. Eylorin may, in its sole discretion, remove, deny access to Eylorin Products, Services & Solutions or from being activated for a particular Eylorin Products, Services & Solutions, and Eylorin may also revise at any time the eligibility of specific or general Eylorin Products, Services & Solutions accounts or access and other accounts or access that constitute eligible accounts or access.

The Eylorin Products, Services & Solutions application might require or include downloadable software, this software may be updated automatically on your device once a new version or feature is available. Some Services may let you adjust your automatic update settings on your device.

You may not copy, modify, distribute, sell or lease any part of Eylorin Products, Services & Solutions or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

You agree that Eylorin may provide you with notices and other disclosures in connection with the Eylorin Products, Services & Solutions by email, postings on the Website or other forms of electronic communications in accordance with Eylorin’s electronic communications policy. All electronic communications from us to you shall be deemed to be communications “in writing” and deemed delivered to you no later than the earlier of the date actually received or five days from the date of posting or dissemination. We are not obligated to provide any additional hard copy communications to you related to your use of Eylorin Products, Services & Solutions.

It is your responsibility to ensure that you check your emails regularly for communications from us. You must ensure that emails from us are not blocked on your email account, and also that the email address you have provided to us remains current. In addition, you authorise us to act on any instructions which are provided by you to us electronically.

c) Account & Access

Your Eylorin Products, Services & Solutions Account will be required to access and use some of the Eylorin Products, Services & Solutions, this will be governed by these terms and those terms of those specific Eylorin Products, Services & Solutions. This might be assigned to you by an administrator like your employer or entity that you are affiliated to. Please note that your administrator might have access or ability to disable your account.

To protect your Eylorin Products, Services & Solutions Account, keep your password confidential. You are responsible for the activity that happens on or through your Eylorin Products, Services & Solutions Account. Try not to reuse your Eylorin Products, Services & Solutions Account password on third-party applications. If you learn of any unauthorised use of your password or Google Account, please follow the prescribed procedure for that specific Eylorin Products, Services & Solutions Account.

In Eylorin Products, Services & Solutions, including displaying in App ads and other commercial contexts, your Profile name, Profile photo, content made private, might be controlled or adjustable in the settings of some Eylorin Products, Services & Solutions. You give Eylorin and affiliates a worldwide licence to use, host, store, reproduce, modify, create derivative works such as those resulting from translations, adaptations or other changes that we make so that your content works better with our Products, Services & Solutions, communicate, publish, publicly perform, publicly display and distribute such content. The rights that you grant in this licence are for the limited purpose of operating, promoting and improving our Products, Services & Solutions, and to develop new ones. This licence continues even if you stop using our Products, Services & Solutions Some Products, Services & Solutions may offer you ways to access and remove content that has been provided to that Products, Services & Solutions. Also, in some of our Products, Services & Solutions, there are terms or settings that narrow the scope of our use of the content submitted in those Products, Services & Solutions. Make sure that you have the necessary rights to grant us this licence for any content that you submit to our Products, Services & Solutions.

d) Security & Data Protection

Eylorin takes all of the necessary technical and organizational security measures to protect data from being lost or misused. For instance, your data is saved in a secure operating environment which is not accessible to the public. In certain cases, your personal data is encrypted.

e) Privacy Policy

Under the Eylorin Privacy Polices & Notice we explain how we treat your personal data and protect your privacy when you use Eylorin Products, Services & Solutions Account. By using Eylorin Products, Services & Solutions Account, you agree that Eylorin can use such data in accordance with our Privacy Policies.

f) Copyright Protection

All ownership rights in Eylorin Products, Services & Solutions, including Content, is retained by Eylorin, its affiliates and their licensors, and protected under applicable copyrights, trademarks and other proprietary (including, intellectual property) rights and international treaties. All rights not expressly granted to you through these Terms are retained by Eylorin, its Affiliates and their licensors. Nothing in these Terms grants to you any right to use any of Eylorin’s, its Affiliates’ or any other third party’s trademarks, service marks, logos or other indicia of origin. An “Affiliate” is an entity that is controlled by, controls or is under common control with Eylorin.

We respond to notices of alleged copyright infringement and terminate accounts of repeat infringers while using Eylorin Products, Services & Solutions according to the process set out in the applicable Copyright Act.

We provide information to help copyright holders manage their intellectual property online. If you think that somebody is violating your copyright and want to notify us, you can write to us on email support@eylorin.com

g) Edits, Changes & Termination

We are constantly changing and improving Eylorin Products, Services & Solutions. We may add or remove functionalities or features and we may suspend or stop Eylorin Products, Services & Solutions altogether. You can stop using Eylorin Products, Services & Solutions at any time, although we would be sorry to see you go. Eylorin may also stop providing Products, Services & Solutions to you or add or create new limits to Eylorin Products, Services & Solutions at any time.

Eylorin grants to you a limited, revocable, non-exclusive, non-sublicensable and otherwise non-transferable license to use the Eylorin Products, Services & Solutions in accordance with these Terms for so long as you are registered in the Eylorin Products, Services & Solutions. Eylorin may in its sole discretion suspend, discontinue or terminate this license at any time, for any reason. All rights not expressly granted to you are reserved by Eylorin, its Affiliates or their licensors.

We believe that you own your data, and preserving your access to such data is important. If we discontinue Eylorin Products, Services & Solutions, where reasonably possible, we will give you reasonable advance notice and a chance to remove information from that Eylorin Products, Services & Solutions.

If you submit feedback or suggestions about the Eylorin Products, Services & Solutions we may use your feedback or suggestions without obligation to you.

Despite termination of these Terms, these Terms continue to apply to any use of the Eylorin Products, Services & Solutions by you prior to termination. Any sections of these Terms that by their nature should survive termination shall so survive any termination of these Terms or your use of the Eylorin Products, Services & Solutions.

h) Disclaimer, Warranties & Limitation of Liability.

Eylorin Products, Services & Solutions, in whole and in part, including all services, is provided on an “as is” and “as available” basis, without express or implied warranties of any kind, including warranties of title, implied warranties or fitness for a particular purpose. we do not guarantee that the Eylorin Products, Services & Solutions system is virus-free or that access to the Eylorin Products, Services & Solutions will be free from interruptions. To the fullest extent permitted under applicable law, you expressly acknowledge and agree that you assume sole responsibility and risk for your use of the Eylorin Products, Services & Solutions, and the results and performance thereof.

In no event and under no cause of action, including negligence, shall Eylorin and its affiliates, and each of their respective officers, directors, customers, members, employees or authorised agents “Eylorin Parties” be liable for any damages, claims or losses incurred (including direct, compensatory, incidental, indirect, special, consequential or exemplary damages), however caused and under any theory of liability, arising from or in connection with the Eylorin products, services

• solutions and/or these terms, even if a Eylorin party is advised of the possibility of such damages, claims or losses.
• Without limiting the generality of the foregoing, the Eylorin Parties shall not be liable to you or any third party for; –
• your use of or inability to use Eylorin Products, Services & Solutions for any reason, including refusal of your or any third party to authorize transactions,
• any goods, services or information purchased or received in connection with the Eylorin Products, Services & Solutions, including your failure to receive or inability to execute such transactions or actions;
• disputes between you and a third party;
• any inaccuracy, incompleteness or misinformation contained in any information provided through the Eylorin Products, Services & Solutions;
• unauthorised access to, or alteration or loss of, your transmissions, data or other information that is collected, stored or sent in connection with Eylorin Products, Services & Solutions transactions or actions;
• errors, system down time, network or system outages, file corruption or service interruptions; or
• any other use by you of the Eylorin Products, Services & Solutions. in addition, the Eylorin Parties shall not be liable for any failure to perform any obligations contained in these terms due to, directly or indirectly, the failure of any equipment, transmission or delivery problems, or any industrial dispute, war, natural disaster, act of terrorism, explosion, act of god or any other event beyond our control.

Notwithstanding anything to the contrary contained herein, the Eylorin Parties’ cumulative liability to you arising from any cause of action will at all times be limited to the lesser of (a) your actual loss; or (b) $100 (or equivalent in local currency).

Some jurisdictions do not allow the disclaimer, exclusion or limitation of certain warranties, liabilities and damages, so some of the above disclaimers, exclusions and limitations may not apply to you. in such jurisdictions, the Eylorin Parties’ liability will be limited to the fullest extent permitted by applicable law. nothing in these terms excludes the Eylorin Parties’ liability for (a) death or personal injury caused by its negligence, (b) fraud or fraudulent misrepresentation, or (c) any matter which it would be illegal for the Eylorin Parties to exclude or limit or attempt to exclude or limit liability.

Other than as expressly set out in these terms or additional terms, neither Eylorin nor its suppliers or distributors makes any specific promises about the Eylorin Products, Services & Solutions. For example, we do not make any commitments about the content within the Eylorin Products, Services & Solutions, the specific functions of the Eylorin Products, Services & Solutions or their reliability, availability or ability to meet your needs. We provide the Eylorin Products, Services & Solutions “as is”.

Some jurisdictions provide for certain warranties, like the implied warranty of merchantability, fitness for a particular purpose and non-infringement. To the extent permitted by law, we exclude all warranties.

We may modify these terms or any additional terms that apply to Eylorin Products, Services & Solutions to, for example, reflect changes to the law or changes to our Eylorin Products, Servicesunauthorised access to, or alteration or loss of, your transmissions, data or other information that is collected, stored or sent in connection with Eylorin Products, Services & Solutions transactions or actions;

If there is any inconsistency between these terms and the additional terms, the additional terms will prevail to the extent of the inconsistency.

These terms govern the relationship between Eylorin and you. They do not create any third party beneficiary rights.

If you do not comply with these terms and we do not act immediately, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future).

If it turns out that a particular term is not enforceable, this will not affect any other terms.
